Jamie McCourt -- Drowning AND Swimming
With the IRS breathing down her neck ... and with her team in financial ruin ... L.A. Dodgers co-owner Jamie McCourt just got approval to build herself an ultra-private, super-expensive beachfront dream pool ... TMZ has learned.
According to documents filed with the city of Malibu ... Jamie asked for city approval to begin construction at her sprawling beachfront mansion.
McCourt wants to expand an existing pool -- and needed permission to excavate 105 cubic yards of earth material. McCourt also wants to expand her wood deck, replace pool equipment and convert a guest room into a pool cabana.
The city approved Jamie's request -- under the condition she doesn't install any lighting systems that will be visible from the beach.
Jamie is VERY serious about her time in the pool -- as TMZ previously reported, she went to war with her estranged husband Frank McCourt over "exclusive rights to the family swimming pool" at her other home in the Hollywood Hills.
But after all the work she's doing in Malibu, Jamie might never need to leave her place again.

NBA Star J.R. Smith Busted ... for Illegal Scootering
J.R. Smith is not going to gain any street cred from this arrest -- he was popped in Miami this weekend for operating a scooter without a valid driver's license. THUG LIFE!!!!
Law enforcement sources tell TMZ ... Smith, who has played the last five seasons with the Denver Nuggets, was not taken to jail for the offense. We're told Smith signed a notice to appear -- he'll get his court date later.
South Beach beware -- Smith was released on his own recognizance.
No word on what happened to the scooter.

Avril Lavigne -- Take Me Out to the F*@&%+ Ball Game!
Avril Lavigne was all smiles when she threw out the first pitch before last night's Tampa Bay Rays game, but she lobbed a few four-letter words at the crowd when a technical glitch messed with her post-game concert.
According to local reports, Avril's mic didn't work at the start of her show ... and she responded to the cavalcade of boos by yelling obscenities at crowd.
Rays rep Rick Vaughn tells TMZ, "The Rays demand profanity-free performances from all of our concert performers and we are extremely disappointed by the language used in last night's show. It is not consistent with the family-friendly atmosphere that Tropicana Field is known for."
Calls to Lavigne's rep were not returned.
UPDATE -- Several of our readers were in attendance last night and point out via our message board ... that while Avril did drop a few F-bombs, they weren't directed at anyone in particular. Her real fans, it seems, enjoyed the show just fine.

NFL Legend Warrick Dunn -- I'm No Gun Runner!
Former Atlanta Falcons running back Warrick Dunn says he feels "violated" -- after cops pulled him over outside ATL and told him he had the characteristics of someone "transporting drugs and guns."
36-year-old Dunn says cops told him they pulled him over because his tinted windows were "too dark" ... but Dunn insinuates he was racially profiled.
During the stop, Dunn -- who is black -- says 4 white officers targeted him with "a lot of personal questions" and told him "I had the characteristics of people transporting drugs & guns."
Dunn says the cops searched his car and gave him a warning for the tint.
After the incident, the 3-time Pro Bowler went to his Facebook page and said, "Felt violated and I've had my car since '08, nvr been pulled ovr for tint. Taken back bc I think the reasoning was bad. Ruined my day but not my spirit."
UPDATE: Dunn's rep tells us Warrick was frustrated after the incident -- and after cops explained that he was traveling through a high-crime area ... he understood the officers were just trying to do their job.
Warrick, through his rep, tells TMZ ... "As the son of a hard working police officer, I understand the stress that police officers are under."
Dunn adds, "The real lesson in all this is that Twitter is a powerful tool but what happened to me is the same thing that happens to a lot of people every day. I’ll take care of it through the appropriate channels just like everyone else has to."

Dodger Beating -- Daughter Backs Suspect Alibi
The 9-year-old daughter of Dodger Stadium beating suspect Giovanni Ramirez has given a sworn statement supporting his claim he never set foot in the stadium on Opening Day ... when Bryan Stow was attacked.
TMZ obtained a photo of Giovanni and his daughter -- as well as the girl's statement ... detailing how she and her father spent March 31.
In the statement -- given to Giovanni's attorney Chip Matthews -- the girl says they were at an aunt and uncle's home early that day ... when her dad gave her a $100 bill to go buy a drink for him at a nearby store. She says her father was napping with his girlfriend at the time.
After the pickup, the girl says she played basketball with a cousin outside the house -- and then at 2PM left with her aunt and uncle to go get another cousin from school. She says when they returned she hung out with her father and family -- at the house -- for the rest of the day.
Matthews says, if necessary, the girl will testify on her father's behalf.

Randy "Macho Man" Savage was in possession of a high-powered handgun when he crashed in Florida last week ... but TMZ has learned Savage had an active permit to carry the weapon.
TMZ spoke with Randy's brother, Lanny Poffo, who tells us the gun was properly registered and legit.
Lanny says Randy had recently gotten into the hobby of target shooting -- and was a pretty damn good shot.
Lanny says Randy and his wife were so passionate about the hobby -- he wasn't surprised about the discovery of the gun because the couple went shooting together all the time.

Macho's Last Request -- Don't Play My Theme Music!
"Macho Man" Randy Savage's ashes were spread at the base of a tree at his Florida home yesterday ... and in compliance with his final request, the family REFUSED to play his wrestling theme music during the ceremony.
TMZ spoke to Randy's brother Lanny Poffo who tells us Savage made it very clear in his funeral plans ... NO ONE was to play his theme music, Pomp and Circumstance, while he was laid to rest.
We're told ... in recent years, Randy felt extremely guilty about using the song, because it was first used by his idol, wrestling legend Gorgeous George ... and Randy felt like he stole George's thunder.
Poffo tells us Randy's closest friends and family members will meet again in Florida tomorrow to continue to mourn and honor Savage's memory.

Accused Dodger Stadium Attacker's Photo Alibi
The man accused of brutally beating a San Francisco Giants fan outside Dodger Stadium in March has photos which he says prove he was not even there the day of the attack.
Giovanni Ramirez has given his lawyer pictures of a group of people who went to see the game on March 31. The photos show Ramirez' ex-girlfriend and other friends at the park next to the stadium, but he is nowhere to be seen. Ramirez' point -- if he was there, the pictures would prove it.
Ramirez claims he was babysitting at his ex-girlfriend's apartment when the attack on Bryan Stow occurred.
We asked Ramirez' lawyer, Chip Matthews, why his client would hang with his ex-girlfriend. Matthews says they remained close after the break-up.

Exec. producer Todd Lubin tells New York Magazine the decision to hire Anna was all part of an effort to reboot the show for it's 12th season.
We're "getting slightly away from just the tape measure, and getting into overall well being and health. That's where Loser needs to go" explains Lubin.
He continues ... "She grew up with very little in Moscow, pounding tennis balls every day when she was 5. That's the drive she's bringing to the show."

Kyle Busch on Speeding Bust -- 'I Got Carried Away'
Kyle Busch just issued a sort-of apology for his 128 mph speeding ticket -- chalking up his ridiculous speed to a test drive gone wrong, and the blatantly obvious ... "I got carried away."
In his statement Busch says , "I was test driving a new sports car and I got carried away. I went beyond the speed I should have been going on a public road. I apologize to the public, my fans, sponsors, and race teams for my lack of judgment."
The NASCAR bad boy was driving a Lexus LFA when cops in Troutman, NC pulled him over today ... doing 128 mph in a 45 mph zone. BTW ... the LFA packs about 552 horses!
Busch added, "I take responsibility for my actions and I can assure you that something like this will never happen again."
