Hoops superstar Kevin Durant is one game away from losing the NBA Finals, and now one lawsuit away from losing his famous nickname -- "Durantula" -- because a guitarist claims KD jacked it from him.

Durant was sued today in Federal Court by a guy named Mark Durante -- a guitarist who, according to the lawsuit, was a big deal in the 80s ... playing with Public Enemy, The Aliens, The Next Big Thing, and (our favorite) The Revolting Cocks.

TMZ obtained a copy of the lawsuit, in which Durante says he adopted the name "Durantula" for his "on-stage and performance persona" -- and has used it to market "music, recordings, apparel, t-shirts, guitars, and related merchandise."

Meanwhile, sports fans have adopted the handle for the Oklahoma City Thunder star and current NBA scoring champ.

Durante claims he sent KD's people a couple letters "demanding they stop using the nickname" -- but says Durant's reps claimed he wasn't using it.

In the suit though, Durante claims Nike has used the moniker to launch a shoe campaign -- and KD himself signed "Durantula" on basketballs that are for sale through his website.

The guitarist says he registered the "Durantula" trademark. He's suing for damages and an injunction stopping KD from using the name.

John Cena's estranged wife is convinced ... the WWE superstar was bangin' around behind her back during the marriage ... and now she's on a mission to prove it in court.

TMZ broke the story ... John blindsided his high school sweetheart Liz Cena with divorce papers back in May after 3 years of marriage.

Now, Liz's attorney Raymond Rafool tells TMZ ... they've been getting tips Cena had been messing around during the marriage ... which, if true, could be grounds for Liz to challenge the prenup.

"We're definitely following up on every lead relative to his being unfaithful before AND after the separation," Rafool says.

So far, it's unclear if Liz's camp has found any real leads.

L.A. Kings defenseman Drew Doughty is being investigated for rape following an incident back in March -- when a woman accused him of forcibly having sex with her -- but TMZ has learned, the D.A. will be rejecting the case.

Law enforcement sources tell TMZ, the woman in question filed a police report following the March 1st encounter -- claiming she bumped into Doughty at a bar in Hermosa Beach early that morning, and he asked her to come back to his place.

We're told ... the alleged victim told police she loudly rejected Doughty in front of his teammates -- calling him an "a**hole" -- and his teammates laughed.

Sources say the girl told police Doughty was embarrassed following the diss -- then wrangled her into a cab, took her home, and raped her.

The girl said she took a cab back to her place after the sex and later went to the hospital -- where police interviewed her and collected rape evidence.

The case has been under investigation since -- but police sources tell us, it will be rejected by the D.A. due to lack of evidence. We're told law enforcement has "major issues" with the woman's credibility.

Bottom line -- Doughty will be off the hook.

TMZ has obtained the mug shot taken of Dwyane Wade's ex-wife ... moments after she was arrested this weekend for allegedly attempting to abduct the former couple's two children.

A rep for the Cook County Sheriff's Office released a statement saying, "Siohvaughn Funches-Wade was charged with two counts of attempted child abduction, two counts of unlawful visitation interference and one count of resisting arrest."

Funches-Wade's bond was set at $10,000 ... which she posted. She's set to appear in court again in August.

Wade -- who's currently in the middle of the NBA Finals -- has been at war with his ex ever since they divorced back in 2010. Wade was awarded primary custody of their two boys ... and Siohvaughn has visitation rights ... but she's clearly not happy with the current arrangement.

The financial details of their divorce are not yet finalized -- and in recent court docs, Wade said his ex has been using the children as "the proverbial pawns in this contentious dissolution of marriage action."

Wade wants the judge to suspend Siohvaughn's visitation rights because of the incident that led to her arrest.

Jerry Sandusky told Bob Costas back in November -- "I didn't go around seeking out every young person for sexual needs that I've helped." Yet that damning statement was never aired on NBC, and prosecutors in the molestation case have not played it for the jury.

"NBC Nightly News" aired the statement last night ... As for why NBC didn't air it during the November broadcast, a spokesman told us, "There were a lot of compelling comments in the original interview but we did not have time to include them all."

Kris Humphries hasn't burned ALL of his Kardashian bridges -- it seems he still has a friend in Khloe ... who insists her sister's estranged husband is a "good guy."

Khloe was leaving La Scala in Beverly Hills yesterday when we asked how she felt about Kris' extortion case with his ex-girlfriend Myla Sinanaj.

Khloe -- who seemed pretty concerned about Humphries -- replied, "Well, that shouldn't happen to anyone ... Kris is a good guy."

We asked Khloe if she thought Kris and Myla really had a boyfriend/girlfriend relationship ... Khloe shot back, "I don't know who [Kris is] f**king, it's just not my sister, that's all I know."

Kim Kardashian has just served Kris Humphries' ex-girlfriend, Myla Sinanaj, with a subpoena in the divorce case ... TMZ has learned.

As TMZ first reported, Myla was in a boyfriend/girlfriend relationship with Kris since mid-January -- something Kris was desperately trying to hide ... to the point his people lied about the relationship.

As for why Kris wanted to cover it up ... sources tell us Kris and his lawyer were worried it would have an impact on the divorce case. We know Kris demanded $7 million from Kim, claiming she devastated him by filing divorce papers. It's hard to say he was devastated when he moved on two months after divorce docs were filed.

Sources say Kim's lawyer wants to know if Kris said anything about his marriage which might relate to his claim Kim defrauded him -- in other words, did he blow his cover during pillow talk. We're told Kim's lawyer also wants details about hundreds of texts and emails exchanged between Myla and Kris.

Myla's lawyer, Joe Tacopina, accepted service on behalf of Myla.

Tacopina tells TMZ his client will comply with the subpoena.

Mike Tyson had a serious problem with banging hookers -- a confession he blurted out during a bizarre interview on live TV.

Iron Mike was on NBC Today when Ann Curry asked him about becoming vegan -- but his answer had ZERO to do with vegetables ... "There's too many prison cells, jails, lawsuits, bankruptcies, women, venereal diseases, too many everything. I got tired of umm, everytime a prostitute girlfriend came back from a trip I had to sleep with them."

New England Patriots wide receiver Wes Welker was kicked out of a fancy restaurant in Aspen, CO Friday night -- after his posse allegedly got into a physical altercation with the bouncers.

According to the NY Post, Welker and a few of his pals hit up the Patron-sponsored Summerology event at Above the Salt restaurant -- part of the Aspen Food & Wine Classic.

Welker and his boys reportedly tried to rush inside the event without checking in with the door people ... so security stepped in and physically restrained the Super Bowl scapegoat.

Welker's crew was pissed -- and sources tell the Post, tensions were running so high, a fight nearly ensued.

According to the Post, cops responded to the scene and booted Welker's group from the property.

Roger Clemens was found NOT GUILTY of lying to Congress when he denied using steroids and HGH back in 2008.

In fact, the former Cy Young winner was acquitted on all 6 charges -- including 2 counts of perjury, 3 counts of making false statements and 1 count of obstructing Congress.

Here's the backstory -- a federal panel was tasked with investigating several baseball players in the wake of the Mitchell Report, which connected tons of MLB players to performance-enhancing drugs.

Clemens had been named in the report, but denied using any illegal substances. But Roger's longtime personal trainer Brian McNamee later accused Clemens of lying ... saying he personally injected Clemens with PEDs for years.

Prosecutors believed McNamee and filed charges against Clemens -- but today, a jury found there was not enough evidence to convict Roger on any count.

2:43 PM PT -- Roger just gave a very emotional statement to the media ... thanking his legal team, his family and all of the former teammates that came to his defense.

There were no Tigers at the U.S. Open trophy ceremony ... but there was a crazy Bird Man ... and now the guy who snuck past security and stole the show by bird-calling on live TV is vowing to do it again.

TMZ spoke with the man ... (he ONLY refers to himself as "Jungle Bird") ... who admits he had a few beers before jumping in front of Bob Costas and U.S. Open Champ Webb Simpson at Sunday's big trophy celebration at the world famous golf tourney.

But this was no drunken stunt -- JB says it was a premeditated mission to raise awareness about global deforestation ... explaining, "I want people thinking about saving trees."

Of course, security ripped him off the course and handed him over to the San Francisco PD -- but JB says the officers were laughing with him and making bird noises at the station. They eventually let him go because the U.S. Open did not want to press charges.

So how did JB manage to breach security in the first place? "It was quite easy," he explains ... "There was security there but everyone was caught up in the moment and they were distracted."

Jungle Bird Man insists we haven't seen the last of his foul feathered ways ... telling us his next bird strike will go down in the U.K. -- "The House of Commons is the next port of call."

Former UFC champ Tito Ortiz is backing down in his war with an alleged drug-fueled stalker ... TMZ has learned.

TMZ broke the story ... Ortiz had filed a request for a restraining order against Shana Burroughs -- a former friend of his baby mama Jenna Jameson who would allegedly come to his house with all sorts of prescription drugs ... including Xanax and Oxycodone.

The Oxycodone is problematic because Tito has said in the past that Jenna has struggled with the drug.

Ortiz also claimed Burroughs was stealing stuff from their house and would scare their children.

A hearing on the restraining order was set for Friday -- but Tito was a no-show ... so the judge tossed out the case against Burroughs.

OK, so HE was the one who went topless ... but DAMN.

New England Patriots tight end Rob Gronkowski ditched his shirt ... and donned a pair of d-bag shades ... to host the Hot 100 party at Wet Republic on Vegas this weekend.

Of course, Rob isn't shy about his ridiculous physique ... dude tore off his shirt at a Super Bowl after-party back in February ... a move that was highly scrutinized 'cause his team had just LOST.

Kris Humphries' ex-flame Myla Sinanaj threatened to release sordid details about her relationship with Kris ... and TMZ has the voicemail.

Sources say ... after photos of Myla and Kris began leaking, Kris broke off all contact with her. Myla became enraged after trying in vain 17 times to reach Kris and then called one of his friends.

Myla left a message, demanding that Kris stop stonewalling her and return her calls.

Myla says, "If he's going to play me like that, I have way more sh*t I can put out."

The voicemail does not show alleged extortion on Sinanaj's part, as Humphries claims. Nonetheless, we're told Kris' lawyers gave it to the FBI when they made their extortion complaint.

Myla's lawyer, Joe Tacopina, tells TMZ, there was no evidence of extortion and unless Kris and his lawyer apologize immediately they will both be on the receiving end of a defamation suit.

Tacopina says Myla was indeed angry when she read that Kris was calling her a "booty call." Tacopina says hundreds of emails and text messages show Myla and Kris were in a "substantial relationship," with Myla meeting Kris' parents, helping his sister shop for furniture for her new apartment and spending many evenings together at home cooking meals.

Chris Webber has run out of timeouts with the State of California and now they've filed a six-figure tax lien against the five-time NBA all-star ... TMZ has learned.

According to documents filed by the California Employment Development Office, CWebb owes the state for unpaid taxes from the last few months of 2008 and all of 2009. The initial amount was for $81,427.36, but with $25,874.56 in penalties and $11,629.05 in interest ... the former Sacrament King now owes $118,930.97.
